COOPER&BURNETT Posted November 19, 2012 Report Share Posted November 19, 2012 Here's an little known article from 1986.Miami Vice' star files suit against National Enquirer FRI 12/26/1986 HOUSTON CHRONICLE, Section Houston, Page 11, NO STAR Edition SAN FRANCISCO - Actor Philip Michael Thomas, who plays Inspector Rico Tubbs on the "Miami Vice" TV show, is suing the National Enquirer for $10 million, claiming an article about his convict brother smeared the Thomas family. The suit filed Tuesday in U.S. District Court asserted that the "substantially false and defamatory" article was written in such a manner to expose the Thomas family to "hatred, contempt, ridicule. . ." The suit did not challenge the fact that Marcus Thomas, 40, is serving a 27-year prison term at California's Soledad Prison for raping and burglarizing three women. But the actor claimed an invasion of privacy because his brother's imprisonment "was not generally known" before the weekly national newspaper published the article on Dec. 24, 1985. The suit also asserted that the publication used an unauthorized picture of Marcus Thomas and that the article and accompanying photographs were printed with "intent to smear, scandalize and libel plaintiffs and all of their family." The actor also said in the suit that the article would cost him an unspecified amount of salary in the future. Thomas suggested that the paper's frequent use of words such as "shocking and brutal" was unfair since the evidence that convicted Marcus Thomas was circumstantial at best. Thomas, 37, maintains that his older brother is innocent of all crimes, noting that Marcus Thomas was a model student with no criminal record prior to his arrest.
